作者接触的顾问单位中,大部分的餐饮企业、教育行业会采用非全日制工的方式达到节省企业用工成本的目的,对非全日制工制度的不熟悉,造成了以非全日制之名行全日制之实的情况。

一、时间规定要谨慎

《劳动合同法》中规定,劳动者在同一用人单位一般平均每日工作时间不超过四小时,每周工作时间累计不超过二十四小时。

张某入职甲公司,甲公司与张某签订《非全日制用工协议》,协议约定:“张某工作时间为周一至周五的上午8:30至13:00,每月劳务费700元。”

法院认为:《非全日制用工协议》约定,张某日工作时间为四个半小时,超出了非全日制用工中的四小时规定,故甲公司主张张某为小时工的用工形式,依据不足,本院认定双方系全日制用工形式。

根据《劳动合同法》的规定,非全日制用工的工资支付周期最长不得超过十五天。用人单位不要图方便,将全日制员工和非全日员工的工资一同发放。

注意:可以在《非全日制协议》中约定月薪,但是支付方式一定要符合法律约定。每个省市对当地最低工资标准均有明确规定,其中也会写明非全日制用工最低小时工资,若用人单位支付小时工资低于最低标准,支付不足的部分用人单位要补发给劳动者。

三、禁止“试用期”
